1. General Provisions

1.1 Dashmotion ("Service," "we," "us," or "our") is an AI-powered photo animation service operated by an individual developer based in Shenzhen, China. By accessing or using our service at dashmotion.online, you agree to be bound by these Terms of Service.

1.2 Any person using our services is considered a client ("Client," "User," or "You"). Our services are intended only for natural persons of legal age (18 years or older).

1.3 We provide services that include a variety of functions utilizing artificial intelligence, specifically designed to transform static images into dynamic videos using advanced generative AI technology. These services include image-to-video transformation and various animation styles.

1.4 By using the Service in any scope, you agree to this Agreement and any other rules governing the Services. Using our Services constitutes acceptance of these Terms.

2. Account Registration

2.1 To access and use our Services, you must create an account by providing:

• A valid email address
• A unique password created by you
• Confirmation that you agree to these Terms of Service and our Privacy Policy

2.2 By creating an account, you declare that the information provided is true, complete, valid, and up-to-date.

2.3 Accounts are for personal use only. You shall not share your login credentials with any third party or unauthorized person.

3. Suspension of Services

3.1 We reserve the right to suspend any provision of Services and/or remove access to your Account at any time if:

• You breach material obligations under this Agreement
• You are not of legal age
• You violate the Agreement or any other related rules
• Your actions pose security, reputational, or financial risks to us or third parties
• Your actions breach any applicable law or regulation

3.2 In case your right to access the Service is suspended, we will inform you via email with the reason for suspension.

4. Payments and Subscriptions

4.1 Our Services are available for a fee. The current pricing is displayed on our website and is subject to change at our discretion.

4.2 All prices are in USD unless otherwise indicated.

4.3 Subscription Plans: We offer the following subscription options:

• Weekly plan: 4 Credits per week
• 1-month plan: 20 Credits per month
• 2-month plan: 40 Credits every two months

4.4 Auto-Renewal: Following the conclusion of your initial subscription, your access to the Services will be auto-renewed for an additional period at the then-current subscription rate. You can cancel auto-renewal at any time.

4.5 Payment Processing: All payments are processed securely through Stripe. We do not store your payment card information on our servers.

4.6 Cancellation: To cancel your subscription, you must provide notice at least 2 days before the start of the next billing period by contacting us at [email protected].

5. Refund Policy

5.1 Generally, no refunds will be issued for any paid subscription periods, except under the following conditions:

• 14-day policy: You may be eligible for a refund if you contact us within fourteen (14) days of subscribing and have not used any credits from the subscription (the initial credit provided during signup does not count).
• Service failure: You may be eligible for a refund if the Services were not provided due to our fault.
• Exceptional cases: We may, at our sole discretion, issue a full or partial refund if your request is well-founded and circumstances indicate that a refund is reasonable.

6. Intellectual Property

6.1 Subject to this Agreement, we grant you a non-exclusive, limited, non-transferable, and revocable license to use our Services for personal, non-commercial purposes.

6.2 Unless otherwise stated, we own the intellectual property rights in the Service, including but not limited to the website design, code, and documentation.

6.3 You retain all rights to the photos you upload. The AI-generated content created from your photos is licensed to you for personal use.

6.4 You shall not:

• Republish, sell, rent, or sub-license our materials
• Reproduce, duplicate, or copy materials for commercial purposes
• Edit or modify any materials on our Service
• Use our Service in any way that may damage or impair its availability

7. User Content and Conduct

7.1 You are solely responsible for the photos and content you upload to our Service. By uploading content, you confirm that:

• You own the content or have the right to use it
• The content does not violate any third party's rights
• You have obtained consent from any identifiable individuals in the photos

7.2 You agree not to upload content that is:

• Illegal, harmful, or offensive
• Sexually explicit or pornographic
• Violent, threatening, or promoting harm
• Infringing on intellectual property rights
• Containing malware or harmful code

8. Risks and Disclaimers

8.1 Our Services are designed for entertainment purposes only. You acknowledge that:

• AI-generated content may not accurately reflect reality
• Results may vary and are not guaranteed
• You use the Service at your own risk

8.2 The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.3 We are not responsible for any outcomes of AI-generated content. AI outputs are produced through automated, probabilistic models and may not always meet expectations.

9. Third-Party Services

9.1 We use third-party services to provide our Services, including:

• Stripe for payment processing
• Cloudflare for storage and content delivery
• Replicate for AI processing
• Supabase for authentication and database

9.2 These third-party services are subject to their own terms and conditions. We are not responsible for the provision of such services or the processing of data by these third parties.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10.2 Our total liability for any claims arising from or relating to these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.
